What are the differences between this LOA and what we have currently for the mediation process?

A
Currently, we have direct discussions with the company and an arbitration process as our tools to resolve non-disciplinary disputes with the company. This LOA adds another dispute resolution tool: mediation. It is a fairly common tool and this mediation LOA was modeled after another ALPA carrier's. The mediation process could help resolve cases short of arbitration. If a mediation turns out to be unsuccessful, the normal processes remain in place, namely being arbitration, which could follow a mediation.

Why is this an LOA and not embedded into our CBA in Section 21?

A
It has the same effect as language written into Section 21. Using an LOA allowed for easier inclusion without adjusting the current Section 21 processes in the CBA. Additionally, it will allow us to update and adapt as necessary as we learn from experience.
